1. COMPETITION ADMINISTRATOR

2. THE COMPETITION
2.1 The title of the competition is “listerinenordic´”. The competition is open to legal residents of Sweden, Finland, and Norway , 18+. Employees at McNeil Sweden AB and its partners as well as employees at the Competition Administrator are not allowed to participate in the competition.
2.2 The competition is a prize draw.
3. PARTICIPATION
3.1 The competition starts 24/10/2023 and ends on 7/11/2023 at 23:59 on @listerinenordic profile.
3.2 All competition entries must be received by the organizer before the relevant closing date. All competition entries received after the relevant closing date are automatically disqualified.
3.3 HOW TO PARTICIPATE
3.3.1 To enter the competition you need to follow @listerinenordic and like the competition post and comment which is your Listerine favorite, and why.
3.4 The Competition Administrator is not responsible for: entries that are lost, fail, or delayed, for any reason, including as a result of, equipment failure, technical failure, system failure, satellites, networks, server, hardware or software errors of any kind. Proof of participation in the competition is not accepted. All internet connection fees and any other expenses that may be incurred as a result of you participating or winning the competition are the responsibility of the participant.
3.5 By participating in the competition, you accept these terms.
3.6. The Competition Administrator is responsible for selecting winners based on a randomized software. The winners will be notified via an Instagram direct message (“DM”) and in the comments field on the competition post through which they entered. To claim the prize, the winners must visit the account @listerinenordic on Instagram within 7 working days to then agree via Direct Message and provide their postal address, otherwise the Competition Administrator reserves the right to award the prize to a replacement selected at the same time as the first winners. If neither the winner nor the substitute claim the prize the Competition Administrator reserves the right to withdraw the prize altogether. The winners are responsible for any costs associated with the recovery of the profit and any profit tax. The Competition Administrator's decision by winners cannot be appealed.
4. APPROVAL
4.1 When you choose to enter the competition, you confirm that you are eligible to do so and eligible to claim the prize you can win. The Promoter and the Competition Administrator may require you to provide proof that you are eligible to enter the competition.
4.2 The Competition Administrator does not accept entries which are: automatically generated by computer; completed by third parties or illegible, have been altered, reconstructed, or manipulated; photocopies and not original or incomplete.
4.3 Posts on behalf of another person will not be accepted and joint submissions are not allowed.
4.4 The Competition Administrator reserves all rights to disqualify entries if the participant's conduct violates these Terms and Conditions and reserves the right to verify entries including but not limited to asking for address and identity information (which must be provided within 7 working days). The Competition Administrator may refuse to award or withdraw the prize, refuse further participation in the competition, and disqualify the participant if there are reasonable grounds to believe that it has violated these Terms and Conditions or where a participant has received unfair advantage in taking part in the competition or winning using fraudulent means.
5. PROFITS
5.1 The competition prize is a product kit composed of
Listerine® Total Care 500ml 4 pcs
Listerine® T&G 500ml 3 pcs
Listerine® Total Care Mild 500ml 5 pcs
Listerine® Naturals 500ml 6 pcs
Listerine® Advance White 500ml 6 pcs
Listerine® Cool Mint 500ml 6 pcs
There will be two winners who will receive a year’s supply of Listerine for them and a friend (60 x 500ml in total). The prize cannot be exchanged for cash. The winners are responsible for any costs associated with the recovery of the profit and any profit tax.
5.2 The prize is provided by McNeil Sweden AB. The Competition Administrator reserves the right to replace the prize with an alternate award of equal or greater value if circumstances are beyond the Competition Administrator's control which makes it necessary to do so.
5.3 The Competition Administrator reserves the right to replace the prize with a prize of equal or greater value.
5.4 The prize is not negotiable or transferable.
5.5 Transfer of prize to the winner takes place under agreement between the winner and the Competition Administrator.
5.6 Competition Administrator has 30 days to deliver the prize to the winner.
6. APPOINTED WINNER
6.1 The winners of the competition will be announced on 09/11/2023 via DM.
6.2 The decision of the Competition Administrator is final, and no correspondence or discussion will be entered into.
7. LIMITATION OF LIABILITY
To the extent permitted by law, the Promoter and the Competition Administrator, their agents or distributors will not be liable for any direct or indirect loss, damage, cost arising in connection with this competition. except when caused by the Promoter or the Competition Administrator's negligence, or the negligence of their agents or distributors or their employees. Your statutory rights are not affected.
8. OWNERSHIP OF COMPETITION AND INTELLECTUAL PROPERTY RIGHTS
8.1 All competition entries and any attached material submitted to the organizer will be the property of the organizer upon receipt and to the completed competition. Personal information collected during the competition will only be used to draw a winner and will be deleted immediately after the end of the competition. By publishing your contest entry and any accompanying material, you agree to the following: (a) assign all intellectual property rights to all organizers with full guarantee; and (b) waive all moral rights, with your contest entry and other arising in connection with your participation, you are now or at any time in the future entitled under the Copyright Act, Designs and Patents Act 1988 as amended from time to time and according to all similar legislation from time to time applicable anywhere in the world.
9. DATA PROTECTION AND PUBLICATION
9.1 If you are the winner of the Competition, you allow the Competition Administrator to use your Instagram account details to notify you that you have won and for all other reasonable and related marketing purposes.
9.2 You further agree to participate in any reasonable publicity required by the Promoter.
9.3 Information regarding personal data, which is provided by you during the course of this Competition, will be processed on behalf of the McNeil Sweden AB by a third party namely Spinn Action Marketing AB, Ynglingagatan 15, 113 47 Stockholm. Personal Data supplied by you will be stored in a database on behalf of the Promoter only for the purpose stated in these ‘Terms and Conditions’ or as separately accepted by you and only processed by Spinn Action Marketing AB as set out in its Privacy Policy: https://spinn.se/feeds/spinn-privacy-policy/
Your personal details will at all times be kept confidential and in accordance with REGULATION (EU) 2016/679 Directive 95/46/EC (General Data Protection Regulation). You can request access to your personal data, or have any inaccuracies rectified, by sending an email to [email protected]. By participating in the competition, you agree to the use of your Personal Data as described here by the Promoter or its agents and suppliers. You can withdraw your consent at any time but will no longer be able to participate. If you have separately agreed to opt in to receive communications from the Promoter or a third party then your Personal Data may be used by them for such purposes, including direct marketing.
10. GENERAL
10.1 The Competition Administrator reserves the right to invalidate, cancel, or change the competition if circumstances beyond the Competition Administrator’s control make it necessary to do so.
10.2 All trademarks and other elements associated with intellectual property rights on this Instagram page (@listerinenordic) are protected by applicable intellectual property protection rules and are the property of McNeil Sweden AB or third parties and may not be used without the written permission of the rights holder.
11. Law and jurisdiction.
11.1 These terms shall be governed by Swedish law, and the parties submit to the non-exclusive jurisdiction of the courts of Sweden
